Subject :- References/Representations/Court Cases in various Ministries/Departments/Organisations for grant of MACPS benefits in the promotional hierarchy – reg.

In continuation of DOPT’ s earlier O.M. of even no. dated 20.01.2016 on the above mentioned subject, the undersigned is directed to forward a copy of the decision of Hon’ble CAT, Ahmedabad bench in OA No. 120/000018/2015 filed by Shri Manubhai B. Rathore Vs. UOI &Ors whereby the demand of the applicant for MACP in promotional Hierarchy has been dismissed.

    A decision once taken is a decion tobe applied and should be implemented in line and spirit. THIS CONTROVERSY IS GOING ON IN ALL THE DEPARTMENTS, MORE PARTICULARLY IN MINISTRYOF RAILWAYS, RAILWAY BOARD, DIRECTOR GENERAL , RPF…BUT , WHO IS GOING TO CARE DoP& T ORDERS, OR GOI ITSELF IN RAILWAY BOARD, RPF ??? DG,RPF ORDERS ARE FINAL FOR ALL ZONES, NO NECESSITY OF SANCTION OR APPROVAL BY FINANCE DEPT…
    IN RPF, EVEN A CLASS III / GROUP’ C ‘ CADRE INSPECTOR GETS GRADE PAY OF Rs.6600/- SA GRADE PAY AS THAT OF DIVL.SECURITY OFFICER, AND ADHOC ASCs are alsogiven SA GRADE OF Rs.6600/- even when they are not regularised… UnMACP SCHEME…NO RULES, NO LAW ENFORCEMENT GOES IN RPF???.
    FOR OTHERS, THEY ARE BEING REVERTED BACK TO GROUP C POST AND FIX Rs.5400/- GRADE PAY IN MACPS, BUT NOT IN RPF, EVEN WHEN THEY DO NOT COMPLETE THREE years REGULARISED CONTINUOUS SERVICE!!!
