 Search Committee Amendment Rules, 2014 – Notification

NOTIFICATION

New Delhi, the 27th August, 2014

               G.S.R.620(E) – In exercise of the powers conferred by sub – section (1) read with clause (b) of sub section (2) of Section 59 of the Lokpal and Lokayuktas Act, 2013 (1 of 2014), the Central Government hereby  makes the following rules to amend the Search Committee (Constitution, Terms and Conditions of appointment  of members and the manner of selection of Panel of Names for appointment of Chairperson and Members of Lokpal) Rules, 2014, namely:—

1. (1) These rules may be called the Search Committee (Constitution, Terms and Conditions of appointment  of members and the    manner of selection of Panel of Names for appointment of Chairperson and Members of Lokpal) Amendment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette

2. In the Search Committee (Constitution, Terms and Conditions of appointment of members and the manner  of selection of Panel of Names for appointment of Chairperson and Members of Lokpal) Rules, 2014  (hereinafter referred to as the principal rules), in rule 3, for sub-rule (1), the following sub-rule shall be  substituted, namely:––

“(1) The Selection Committee shall constitute the Search Committee consisting of at least seven  persons of standing and having special knowledge and expertise in the fields and from the categories of  persons specified in sub-section (3) of section 4 of the Act.”.

3. In rule 10 of the principal rules, ––

(a) in sub-rule (1), the words “from amongst the list of persons provided by the Central Government in the  Department of Personnel and Training” shall be omitted;

(b) for sub-rules (2) and (3), the following sub-rules shall be substituted, namely:–

“(2) The Central Government shall provide such assistance as may be required by the Search Committee in efficient discharge of its functions in accordance with the provisions of the Act.

(3)The search Committee may,for the purpose of short – listing of persons, adopt such short listing norms as it may consider appropriate”,.

(c) sub-rule (4) shall be omitted.

4. In rule 11 of the principal rules,––

(a) in sub-rule (1), for the words, brackets and figures “within a period not exceeding thirty days from  the date of receipt of the list of eligible candidates and other applicants referred to in sub-rule (2) of rule  10 from the Central Government”, the words “within such period as may be decided by the Selection  Committee” shall be substituted;

(b) in sub-rule (2),––

(i) in the opening portion, for the words “The Search Committee shall”, the words “The Search  Committee shall, as far as possible,” shall be substituted;

(ii) in clause (b), for the words “a panel containing at least three times the number of vacancies  advertised”, the words “a panel containing names at least three times the number of vacancies to  be filled” shall be substituted.
