Sub: Children Education Allowance Scheme – ClarificationEducation: A Basic Right for a Better Future by UNHCR

Subsequent to issue of this Department OM No. 12011/32008-Estt (Allowance) dated 02/09/2008 and clarificatory OMs dated 11/11/2008, 23/11/2009 and OM No. 12011/16/2009-(.Allowance) dated dated 13/11/2009 on the Children Education Allowance (CEA) Scheme, this Department has been receiving references from various Departments, seeking further clarifications.

The doubts raised are clarified as under:-

(i). Whether CEA is admissible to a Government Servant who ceases to be in service due to retirement, discharge, dismissal or removal from service in the course of an academic year ? CEA/hostel subsidy shall be admissible till the end of the academic year in which the Government servant ceased to be in service due to retirement, discharge, dismissal or removal from service in the course of an academic year.

The payment shall be made by the office in which the Govt. servant worked prior to these events and will be regulated by the other conditions laid down under CEA scheme.

(ii). Whether Children of a Government servant who dies while in service are still eligible for reimbursement under the new CEA scheme? If a Government servant dies while in service, the Children Education Allowance or hostel subsidy shall be admissible in respect of his/her children subject to observance of other conditions for its grant provided the wife/husband of the deceased is not employed in service of the Central Govt., State Government, Autonomous Body, PSU, Semi-Government Organization such as Municipality, Post Trust Authority or any other organization partly or fully funded by the Central Govt/State Governments. In such cases the CEA/Hostel Subsidy shall be payable to the children till such time the employee would have actually received the same, subject to the condition that other terms and conditions are fulfilled. The payment shall be made by the office in which the Govt. servant was working prior to his death and will be regulated by the other condition laid down under CEA Scheme
iii) Whether any upper age limit of the children has been prescribed for ciaming CEA? Whether CEA can be allowed in case of children studying through “Correspondence or Distance Learning”? If so the age limit prescribed for the same. The upper age limit for disabled children has been set at the age of 22 years. In the case of other children the age limit will now be 20 years or till the time of passing 12th class which ever is earlier. Cases where reimbursement have been already made, in respect of children above this age may not be reopened. It has also been decided that CEA may henceforth be allowed in case of children studying through “Correspondence or Distance Learning” 5ubject to other condition prescribed
iv) What is the definition of the terms ‘two sets 0f uniform’ which occur in para1(e) of our O.M. dated 2.9.08. What is the definition of ‘one set of shoes’? It is clarified that ‘one set of shoes’ would mean one pair of shoes and ‘two sets of uniform’ would mean two sets of uniform prescribed by the school in which the child is studying. A set of uniform will include all items of clothing prescribed for a day, as uniform by the school. Reimbursement may be allowed for two sets of such uniform irrespective of the colours /winter/ summer/ PT uniform
(v) What is the definition of ‘station’ for the purpose of hostel subsidy ? It is clarified that for the purpose of hosted subsidy, station would be demarcated by the first three digits of the PIN Code of the area where the Government Servant is posed and/or residing’. ‘The first three digits of the PIN Code indicate a Revenue District
(vi) Whether fee paid to organizations/institutions other than the school or fee paid to private tutors for purposes mentioned in para 1(e) of the OM dated 2.9.2008 is reimbursable? No. It is clarified that the term ‘fee’ contained in the para 1(e) of the OM dated 2.9.2008 would mean the fee charted by the school directly from the student

    Dear sir,
    My ist issue is one son born in 1995. & 2nd issue twin sons born in 1999.I was getting CEA of 3 sons till 2007 .I am employee of IOCL.Now I am getting CEA of 2 sons since 2008. May I know the rule of Public Sector Undertaking regarding CEA, the 2nd issue twin sons both are entitled for CEA means the 3 child are entitled for CEA ? Early response kindly requested please.

    We have submitted claim for CEA in 2012-13 & 2013-14 for the Bachpan school(Nursery and LKG). We got all reimbursement amount without any query.
    Now after 3 years our accounts office recovered all amount bcoz of registration issue.In maharashtra for Pre.primary no Permission is required.
    Please clarify if JCDA once passed the claim .is it proper way to again reimburse the same

  5. i have 2 sons ,one is studying in annamalai university BE(Civil) 1st year and another in class v th, whether i am eligible to get the scholarship @ Rs.2500/- for staying in hostel as well as Children Education allowance @ RS 3500/- per month or not.

I SUBMITTED A CEA CLAIM FOR MY DAUGHTER STUDYING IN CLASS NURSERY OF AN INTERNATIONAL PRE-SCHOOL AFFILIATED TO CAMBRIDGE UNIVERSITY.MY DEPT HAS REJECTED THE BILL STATING THAT IT IS NOT A RECOGNISED SCHOOL.THE SCHOOL PRINCIPAL REPLIED THAT PRE-SCHOOLING IS NOT RECOGNISED ANYWHERE IN KERALA. KINDLY CLARIFY WHETHER IAM ELIGIBLE FOR CEA.

    Sir,
    mere bete ka admission aug10 mein hua. main march11 tak ka cliam Rs.14000.00 ka kiya. magar 1000/per month ke hisab se keval Rs. 8000.00 ka cliam kiya. CEA Order mein aisa kahin nahi hai ki eight months ka kewal 8000.00 hi milenge.(Bill mein Rs. 8000.00 admission charges & Rs.6000.00 monthly fee for 6 months )

    1)One of younger study in one of the reputed school of KOLKTA ( SOUTH POINT SCHOOL). The school has three classes 9 for three year) before class 1 e.g.,Nursery 1,Nursery 2 and Transition class. I have already reimbursed fees for Nursery1 and Nursery 2 PAO is obejecting to reimburse for for three classes before Class 1 . please clarify wheteher tfees for transition class is reimbursableor not.
    2) my daughters school along with other fees also takes charges for a) annual charge, b) development fee,c) maintenace fee,c) Examination,stationary, power. Please clarify specifically whether these are reimbursable or not

    In the interest of all Govt. employees, please let me know about the reimbursement of Children Education Allowance (Rs.24,000/- per annum for two children) is taxable under Income Tax or not? Is it not covered under Section 10(14) and Rule 2BB of Income Tax. Whereas, earlier(before merger of different educational allowances) it was exempted upto the limit of Rs.100/- per month per child i.e. Rs. 2,400/- per annum for two children. Now the limit has been raised from Rs.100/- to Rs.1000/-(now Rs.1250/- w.e.f. 1.1.2011) per month for one child, why this amount has not been shown under the said Rules on Govt. sites, and as a result some DDO’s has deducted TDS on the reimbursement amount, which is logically incorrect, as this amount has already been included in the taxable income and the same is tax paid, why a Govt. servant is compelled to pay income tax on the same amount again.

  12. MY KID COMPLTED LKG SUCCESSFULL IN STATE RECOGNISED SCHOOL AND FAILED TO GET ADMISSION FOR UKG IN ANOTHER CBSE RECO SCHOOL DUE TO POOR PERFORMANCE AND TEACHERS ADVISE, RETAIN IN SAME LKG. WHETHER ELISIBLE FOR CEA SECOND TIME?

  13. Respected Sir/Madam, Pl clarify that when a child studying in a class is repeated in he same class at the request of the parents, whether he/she is eligible to get the CEA? pl note that the child has not failed but repeating in the same class.

  15. The CEA is not linked with the performance of the child. This means that even if the child fails/retained in any classes/semesters, the CEA will continue. Can the CEA be discontinued if the child fails/retained in the final year/semester or final examination in which the first attempt was available for completing the final year/final sememster or final examination of the course (Nursery to Post Graduate)?

    SIR IN FIRST ORDER THE GOVT. SANCTION CHILDREN EDUCATION ALLOWANCE TO ONLY TWO CHILDRENS OF CENTRAL GOVT. EMPLOYEES. IF ANY EMPLOYEES HAVE MORE THAN TWO CHILDREN THEY MAY GET ONLY TWO CHILDREN EDUCATION ALLOWANCE AND I THINK IT IS JUSTIFIED.

    BUT IN THE 2ND ATTACHMENT YOU CAN SEE GOVT. ORDER IN WHICH IT CLEARLY INDICATES ONLY TWO ELDEST CHILDRENS CAN BE ALLOWED CHILDREN EDUCATION ALLOWANCE TO CENTRAL GOVERNMENT EMPLOYEES.

    SIR YOU CAN REALISE HOW THIS 2ND ORDER IS DENIIED US FROM RECEIVING THIS CHILDREN EDUCATION ALLOWANCE. YOU CAN REALISE THAT FOR OTHER ALLOWANCES OR BENEFITS NO SUCH RESTRICTION OF ONLY TWO EDLEST CHILDREN IS INDICATED, SUCH AS IN LTC OR MEDICAL REIMB. ETC.

    IN ‘LTC’ ORDER IT IS MENTIONED THAT YOU CAN TAKE ANY TWO CHILDREN TO TRAVEL WITH US. BUT FOR EDUCATION ALLOWANCE THEY HAVE CLEARLY INDICATED TWO ELDEST CHILDREN IS ENTITLED FOR CHILDREN EDUCATION ALLOWANCE. IF ANY BODY HAVE MORE THAN TWO CHILDREN WHAT THEY HAVE TO DO. BUT FROM THIS GOVT. ORDER 2ND ATTACHMENT IT RESTRICTED ONLY TWO ELDEST CHILDREN. I PLEAD FOR JUSTICE. AS YOU KNOW SOME OF THE GOVT. EMPLOYEES MORE THAN TWO CHILDREN. IT MAY BE TWO, THREE, FOUR, FIVE OR SIX. THEN WHAT THEY HAVE TO DO. THEY ARE INCURRING HEAVY EXPENDITURE FOR THEIR EDUCATION AND THE EMPLOYEES ARE PREVIOUSLY TAKING ONLY TWO CHILDRENS’S EDUCATION ALLOWANCE IRRESPECTIVE OF MORE THAN TWO CHILDREN. BUT NOW THEY ARE STOPPED FOR GIVING CHILDREN ALLOWANCE TO THOSE EMPLOYEES WHO HAVE MORE THAN TWO CHILDREN AND THEY HAVE ALREADY SUBMITTED THEIR APPLICATION FOR CHILDREN EDUCATION ALLOWANCE. BUT THEY ARE DENIED.

    THEREFORE, I REQUEST YOU KINDLY TAKE INITIATIVE TO CANCEL THE 2ND ATTACHMENT GOVT. ORDER AND SPARE THE FIRST ATTACHMENT GOVT. ORDER. FROM THIS ACT OF KINDNESS MANY EMPLOYEES WHO ARE INCURRING HEAVY EXPENDITURE ON EDUCATION CAN TAKE THIS FACILITY. PL. TAKE THIS AS MOST URGENT BECAUSE FOR 2010-11 ALL APPLICATIONS FROM EMPLOYEES FOR SUCH REASON THEIR APPLICATIONS ARE REJECTED AND THEY ARE DENIED FROM THIS FACILITY ON THE GROUND THAT YOUR CHILD NO. IS THIRD, FOURTH, FIFTH OR SIXTH. I THINK IT IS NOT JUSTIFIED. THE ORDER SHOULD BE LIKE THIS AS STATED IN THE FIRST ATTACHMENT THAT ONLY TWO CHILDREN WHATEVE THEIR NO. I THINK IT IS CLEAR FOR YOU. IF YOU WANT ANY THING MORE. PL. WRITE TO US. KINDLY SENT ME A LINE FOR MY INJUSTICE EMPLOYEES. WITH KIND REGARDS, I AM QURESHI

    sir I have a daughter studying UKG in a private school which is recognised by statement government. her age is 4 and a half years at the time of admission to UKG. when I claimed for CEA my department has returned the claim stating CEA is admissible to the children having the age between 5 to 20 years only. as per the government norms a child should complete 5 years as on 31st March for getting admission to first class. my contention is when the government is allowing CEA from LKG my claim should be admitted even he is less than 5 years of age. more over in the 6th CPC letter nothing has been mentioned about minimum age.
    please clafity whether my contention is correct or not

    Schools are charging different amount as per their nomenclature like Tution Fee, Development Fee, Academic Improvement Charge, Examination Fee, Session Fee, Term Fee etc.

    After submission of bill for reimbursement towards Children Education Allowance, my office did not reimburse the amount charged under heading that does not exist in the Para (e) of OM No.12011/03/2008-Estt.(Allowance) dated 2.9.2008.

    After query from the office, it comes to know that reimbursement will be made only towards the nomenclature, which is mentioned in the above referred OM.

    Kindly clarify, whether fee charged under heading other than those mentioned in the said OM like Session Fee, Development Fee etc. can be reimbursed or not.

    Whether monthly Bus charges directly paid to the school is admissible foe reimbursement, if yes is there any limits. Plese clarify.

  20. Sir, Pl clarify CEA-DOP&T Order and clarification dt. May 28, 2010.The Representative of Staff Side- National Council insisted in the 46th meeting of National Council That the children Education Allowance should be paid to the two studying Children instead of restricting it to the eldest two childrens means……

    My first child born on 12/10/1983. 2nd child born on21/12/1992 and 3rd born on 3/9/1995. First 2child RTF upto Xth std. But my yougest child died in accident. Now Ihave two surving children. Now , what 2nd &3rd child eligible or not please cearfied.

    All school are charging “tuition fees” , and “Term fees” .
    In the O.M. Term Fees has not been included in the list of permissible items for claiming reimbursement. Pl inform whether the
    Term Fee is to be included in the reimbursement or not

  27. What is the outskirt of C.G.H.S.If a person appointed a Central Government office on 16th of any month,then deduction will be made for that month.

Sir, I am servicing in Ministry of Health (Safdarjung Hospital), one of my friend have five children, but till now he DID NOT claimed CEA for any of his children in his entire service, this year he submitted claim for tuition fee (for his youngest two children)at our admin office, but admin office returned his claim with remark that CEA admissible for only two first children (elder). Is it correct ? I am waiting for reply at the earliest please.

  30. sir I have a doubt about Hostel subsidy. I have received a claim for Hostel subsidy for Rs. 36,000/-. Actually there is a central school in the same campus where the government servant is working and the child has studied in the same school upto previous year. now this year that emplyee joined his son to a residential school at the nearby city. as per old rules Hostel subsidy can be allowed where the government servant has to keep his child in hostel or residential school due to his transfer to remote places or field areas or school is not available at the government servant Hqrs. consequent on 6th CPC transfer clause has been removed. my doubt is whether he can keep his child in residential school in the near by city even school is availble in his Hqrs office.

  32. Sir, actually I have 300+15 ELs as on 1st December 2010 and taken 10 Leave encashment along with LTC by taking 5 days CL. My department has first debited 5 days CL from my CL account then 10 days EL from 300 and shown as 290+15. on 1st January 2011 +15 has been lapsed and new 15days EL has been added to 290 and shown as 300+5. my contention is 10 days EL is to be deducted from 300+15 and show it as 300+5 in December 2010 and on 1st January 2011 after adding 15 days it should be shown as 300+15. Please clarify whether my contention is correct or my department is correct.

  33. I have three children i.e. two daughters and one son. Daughters are elder and the son is youngest one. I have not claimed any Education Allowance in respect of my two daughters. I want to know as to whether I am entitled to claim Education Allowance in respect of my son who studies in VI standard. Early reply is solicited.

  34. Sir/ Madam,
    The concessions on account of Children Edn Scheme , to include hostel subsidy, be extended to the higher classes- at least up to under graduate level. Alternatively, IT rebate should be allowed on expdr incurred on higher studies of children( up to two only). This shall go along way to help the govt employees & in the longer run Nation as well.

  36. Let me know that what are the allowances will see increase by 25% after Dearness Allowance crossed 50% marks? Whether Transport Allowance can be included?
