DOPT instructions on Reservation for the SC,ST and OBC-Draft OM

DOP&T Issued an Office Memorandum No.36011/6/2010-Estt.(Res) dated the 25th June,2010 on the Issue of instructions on Reservation for the Scheduled Castes,Scheduled Tribes and Other Backward Classes in services under the Government of India

According to this Office Memorandum the instructions on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in service under the Government of India are contained various OMS issued from time to time by the Ministry of Home Affairs and this Department. Some of the instructions so issued have become outdated and are not in operation at present.

It has, however, been observed that some appointing authorities are continuing to implement such outdated and non-existent instructions. Keeping all these aspects in view this Department(DOP&T) has decided to issue consolidated instructions on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in supersession of all the existing instructions on the subject. The proposal is not to change any aspect of policy on the subject but only to consolidate all the instructions and present them in easy to understand form/language.

A draft OM has been prepared which covers all the aspects of reservation policy as existing at present. However, before issuing the proposed OM, it has been decided to put it in public domain and invite comments on it. If any person feels that the proposed OM does not include any of the existing instruction or any instruction included in the proposed OM is not in consonance with the existing instructions, may point out the same and send his comments to the Director,DOP&T by 12th  July, 2010.

  1. Dear Sir,

    I am a govt. officer and I wish to apply for a higher unreserved post.
    My question is it is necessary to declare my SC status in the application. The confusion is due to….
    1. If I declare SC against reserve post then my application will not be considered as this is a unreserved post.
    2. If I dont declare then my office is not forwarding my application.

    Pl. advice on this issue…

Sir, as it is understood that there is a provision for getting reservation in appointment for OBC but it is not understood why the same is not applicable during promotion also.As in the similar case of backward people like SC/ST candidates are gettings both the benefit during appointment as well as promotion also,then why the OBC are not getting the same being both the categories are under the same social status que.

Inspite of all such memorandums and instructions the Central Excise and Customs Department included in common cadre of Indore/Bhopal/Nagpur/Raipur is not initiating any kind of legal action against the employees who got appointments on the basis of fake or false or bogus caste certificates only warning letters are issued but no action as per those warning is initiated. that because of information and the memorandum on this site it will be helpful to seek redressal from Court of Law

  4. The draft OM regarding instructions on reservation mentions about the relaxation in experience qualification for the direct appointments at the discretion of competent authority.

    May I know if the required experience qualification is 14 years after acquiring essential qualification, to what extent the same may be relaxed, provided there is no other applicants for last 5 years despite repeated vacancy advertisements.

  5. Kindly inform as to whether any Central Government Employee who inadvertently did not claim S.C. status at the time of initial appointment can be allowed to claim S.C. status after putting approximately 20 years service. If yes as per which OM and no then as per which OM.

    in the circulars it is mention that regarding age relexation, wrongly mention against the judgment of supreme court.Now decided that a person got age relexation who also get the stand in general merit, therefore, he entitled to get the appointment as per own merit he also entitiled get appointment in the merit of general.
