Anomaly in annual increment arising due to the implementation of 6th Central Pay Commission Recommendations

The point regarding the anomaly in annual  increment relating to Rule 9 of the CCS (RP) Rules, 2008, concerning the date of next increment has been discussed in second Anomaly Committee meeting held on 27th March 2010. According to the Minutes of the meeting, Published by DOP&T on 4th May 2010, the Staff Side reiterated their demand that employees whose date of next increment falls between 1st February to 1st June may be given an increment, as a onetime measure, in the pre revised pay scales on 1.1.2006 as has already been done in respect of employees whose next date of increment was 1.1.2006.

The representatives of the Department of Expenditure stated that it is important to first examine the repercussions of granting an increment w.e.f 1. 1. 2006 in the pre revised pay scale because such a decision may eventually lead to certain other anomalies. After a long discussion, it was agreed that the Official Side would re- examine the matter and either suitable clarification in this regard will be issued before the next meeting of the National Anomaly Committee or if there is a need, the Department of Expenditure shall discuss the matter again with the representatives of the Staff Side.

But ,as agreed by the official side,the suitable clarification not been issued till now .

Dear Sir,

I like to invite government’s kind attention to the minutes of the second meeting of National Anomoly Committee held on 27th March,2010 and like to convey my sincere gratitude as an individual for the concern shown by Govt. representatives and representatives of Staff side in resolving the anomalies out of 6th CPC.

While discussing the Agenda No.5 (v), the representatives of the Govt. had expressed apprehension that granting an increment w.e.f. 01.01.2006 in pre-revised pay- scale to those employees whose date of next increment falls between 1st February to 1st June, as a one time measure may eventually lead to certain anomalies and therefore proposal had to be examined first. In this connection, I would like to submit that by all probabilities, it may not create anomaly because the seniors got this benefit by taking the increment on or before 01.01.2006. However more realistic approach could be to revise the pay on the date of increment / promotion between 01.02.2006 to 01.06.2006 and allow the next increment on 01.07.2006. In this case the employees may forego the arrears for the period from 01.01.2006 till revision of pay as they will draw pre-revised pay till then.

I hope the official side will come out with an appropriate solution to solve the anomaly. Needful to mention that my increment date was 01.02.2006 and retirement date falls on 31st March. The increment drawn for the period from 01.02.2006 to 30.06.2006, 01.02.2007 to 30.06.2007 and 01.02.2008 to 30.06.2008 in the pre-revised grade have been withdrawn and my arrears were very less than my juniors due to postponement of increment dates. Besides, it will effect my pensionary benefits because my retirement date falls on 31st March, whereas before 6th CPC, the increment date was 1st February i.e. before my retirement and my pension would have fixed after drawal of increment.

I hope, the Govt. will consider the issue sympathatically and issue necessary orders to settle the anomaly so that we are not put to regular financial loss, including pensionary benefits.

    I have the honour to inform you that I have joined in the office on 9th May, 1996. My date of birth is 02-02-1972. In terms of sub-para 2(C) of para 2 read with 6(a) of G.I.O 14 below F.R. 26. I have granted exemption with effect from 9th May, 2006 after completion of 10 years of service as LDC due to I have made two genuine attempts to pass the typing test. I appointed to the post of LDC in the scale of pay Rs. 3050-75-3950-80-4590/- on compassionate ground. Accordingly office was granted increment with effect from 9th May, 2006 @Rs. 75/- for ten years total Rs. 750/- raising pay from 3050/- to Rs. 3800/- without any areas for the period prior to the date of exemption, subject to the retention of normal date of increment.
    Now as per latest order No. 10/02/2011-E.III/A dated 19th March, 2012 regarding Central civil services ( Revised Pay) Rules 2008- date of next increment in the revised pay structure under Rule 10 of the CCS(RP) Rules, 2008 wherein it is stated that those central government employees who were due to get their annual increment between February to June during 2006 may be granted one increment on 01.01.2006 in the pre-revised pay scale as a one time measure and thereafter will get the next increment in the revised pay structure on 1.7.2006 as per Rule 10 of CCS(RP) Rules 2008. The pay of the eligible employees may be re-fixed accordingly.
    As per 6th CPC my pay was fixed as follows:
    01-01-2006 Rs. 3725/- fixed to Rs. 6930/-
    09-5-2006 Rs. 6930/-
    01-7-2006 Rs. 7200/-
    01-7-2007 Rs. 7480/-
    01-07-2008 Rs. 7770/-
    I shall be highly obliged if you kindly inform me that may I eligible to get one increment on 01-01-2006 in the pre-revised pay scale as per order No. 10/02/2011-E.III/A dated 19th March, 2012.

I DO NOT UNDERSTAND WHY IT DID NOT OCCUR TO ANYONE THAT WHILE CALCULATING THE INCREMENT AS ON 01.07.2006, NOBODY THOUGHT OF GRANTING LESS THAN 3% INCREMENT (CALCULATED AT 0.5% PER MONTH)UPTO MAXIMUM OF 3% FOR PEOPLE COMPLETING 6 MONTHS IN JUNE 2006. THOSE WHO DID NOT WANT INCREMENT IN JULY 2006 OR RETIRING BEFORE THAT COULD HAVE DECIDED OF WHETHER OPTING FOR THE NEW PAY OR OLD. ALL OTHERS COULD GET THEIR DUE. FIXING A SINGLE INCREMENT DATE AND SINGLE RATE OF INCREMENT MEANT LOSS OF AROUND ONE WHOLE YEAR FOR MANY.

  7. Those persons whose increment date fell between February to June 2006, should be allowed increment calculated at 0.5% per month, granted on 01.07.2006. This way they will not get 3% increment (like people having increment on 01.01.2006), and will not be loser also. The concept of variable increment has been accepted by the 6th Pay commission, so it will not be a problem to implement.

    I request all concerned to also voice their request.

  8. i joined as nurseA in hwpm(dae) in october 2006, my education qualification is Bsc nursing and at the time of joinung along with my pay two unabsorbable increments has been granted by board and after sixth pay commission my additionsl increments are merged in the pay.plz suggest me how to get my increments back.

  9. There should be only ONE increment date in a year, which means that it should be ANNUAL increment (but does not necessarily mean that it should be allowed on completion of one full year of service).
    Everyone should get their increment in July (2006). Persons who were to get increment/who were promoted in FEBRUARY 2006 (or before JUNE 2006), should get their increment on 01.07.2006, but instead of full 3%, it should be reduced to 0.5% per month. Persons promoted /with increment date in February 2006 should get 2.5% increment in July 2006, persons getting in March 2006 should get 2.0% increment (as against persons getting full 3% increment by virtue of having increment date in January 2006.

    I request all affected parties to consider this suggestion and forward to those concerned. Thanks

The only solution to this issue is that on 01.07.2007, these persons who had been promoted between Feb to June 2006, or whose increment date fell between Feb to June 2006, should be given higher rate of increment instead of 3%. For example, for every extra month (in excess of 6 full months as on 01.07.2007) completed by an employee, 0.25% increment may be allowed (for the period from Feb 2006 to Dec 2006). Alternately, for the increment dates falling between february and June 2006, 0.5% per month (considering that persons with increment date in January 2006 got a full extra increment of 3%) may be allowed on 01.07.2007.
    This will be in line with the variable increment allowed by the pay commission and also a senior in service will get higher pay compared to the junior.

    I request you to give clarification regarding increment before pay commission my increment date was July only and in 6th pay commission fixed the date of increment on first July my question is myretirement date is falling 30th June 2015. I will get annual increment on first July in 2014 what about the annual increment in 2015? after serving complete 12 months why should I loose my increment due on 1st July what is your answer and what is solution for this kindly give clarification in this regard.

    My DNI was 1/12/2005 and after 6th pay fixation my pay pay fixed Rs 6430 + 2400 GP in revised pay scale 5200 – 20200 + 2400 GP an DNI 1/7/2006. As per Govt orders my pay stepped up w.e.f. 21/01/2006 with Rs 7510 + 2400 GP in revised pay scale 5200 – 20200 + 2400 GP. But my DNI (date of next increement) is granted on 1/7/2007. My revised pay structure was not changed while stepping of pay on 21/1/2006 hence I’m eligible for granting of increement on 1/07/2006. Besided this, after fixation of pay on 1/1/06, the first increement will be given on 1/7/2006. But my department not agree.

  13. Sir, my junior joined in January 1989 and myself on feb 1989 in 1400-2300 scale. Next , i promoted on july 1997 and pay fixation done.whereas my said junior promoted on feb 1998 and having advance increment on jan 1998 his salary was crossed me and was equal with me on july 1998 and that was going on.In the nxt promotion when i promoted on feb 2004 and junior promoted in 2006 and on pay fixation his pay has been crossed me by more than Rs 400 . Now , please recommend advice with proper rules so that I can apply properly to solve this anomaly and my pay should be stepped up at par with junior. Sajal , Dehradun

    As we all know, Govt. of India has placed the employees of subordinate offices, who were earlier in the pre-revised pay scale of Rs. 6500-10500/-, in the grade pay of Rs. 4600/-. Those who are working in the Ministries have been placed in the grade pay of Rs. 4800/- and after completion of 4 years of service, they would be given the grade pay of Rs. 5400/-.

    The employees of subordinate offices have been downgraded and put them behind 10 years (keeping in view the MACP to be given after 10 years). There should also be a provision to give them the grade pay of Rs. 5400/- at least after 6 years of continuous service (not after 4 years). Therefore, I humbly request the concerned authorities to kindly consider providing grade pay of Rs. 5400/- after at least 6 years of service to those who are working in the grade pay of Rs. 4600/- in subordinate/autonomous bodies as Private Secretaries/Section Officers and place the agenda in the ensuing meeting of the Anomaly Committee so that they may come out of the depression.

    The extended life of the National Anomaly Committee is expiring soon on 31st March 2011.The committee has met only twice during its tenure with number if issues still remaining unresolved.When is the next meeting of the committee scheduled?

    By rationalisation of annual increments to July ,the CPC has created an anomalous situation, leading to huge financial loss for those Govt employees who opt for their pay revision on their date of next increment/promotion falling between 2nd January-30th June 2006.To rectify this anomaly,I request the NAC to kindly consider giving them an increment on 1st July 2006,as a one time measure.The NAC may please note that by opting for their pay revision on a later date on their increment/promotion date than 1st January 2006,they have already forfieted their pay revision benefits for the period.

    Similarly for those Govt employees retiring on super-annuation between January to June,the retirement/pension benefits may be given after adding one increment to their last basic pay,since they have served more than six months in their last basic pay.

    I submit both my above suggestions for kind attention and favourable decision of the committee.Regards.

  18. When will the NAC submitting its report to Govt, after settling all 6thCPC anamolies. If the anamolies are not settled, whether any further extention is going to give to NAC.
    The total tenure of 2 years, what are the anamolies settled by the NAC. How much time, they will take to settle all these anamolies. Is there any time frame set by govt. for this.

  19. Pay of the employees promoted after 1-1-2006 have been fixed less than the minimum entry pay prescribed for the grade pay. They should be stepped up to the entry pay prescribed for the GP. What is the anamoly committee’s decision regarding this? Plz intimate.

    The anomaly regarding stepping up of pay according to Item No.19 reflected in the statement inicating the gist of

    decisions taken during the Second Meeting of the Joint Committee on MACPS held on 15/09/10 circulated under

    DOPT OM No.11/1/2010-JCA dt 06 Oct 10, arised due to withdrawal of increment from employees whose increment

    dates falls between 01 Feb 2006 to 30 Jun 2006 in the pre-revised scale of pay. However, if the Govt. would grant one

    increment as on 01/01/2006 in the pre-revised scale of pay, to employees who were due for Annual Increment between

    01/02/06 to 30/06/06 as in the case of persons whose increment date was on 01 Jan 2006 as one time measure, many

    cases pertaining to stepping up can be resolved.

    The minimum pay for employees appointed in Govt. Service after 01/01/2006 has been specified in the CCS (RP)

    Rules 2008 according to Grade Pay. Whether, the same is applicable to promotees (who have promoted after

    01/01/06 and drawing pay less than the minimum prescribed with GP) also under FR-22(I)(a)(1).

    Further, I would like to ask the Govt.Authorities that despite, accepted by the 6th CPC to merge the pre-revise Pay

    Scales of Rs.5000-8000/- and Rs.5500-9000/- into Rs.6500-10500/- Wef.01/01/2006, why the pay of the affected

    employees have been fixed less than the minimum of Rs.12090/- (ie. Rs.6500 x 1.86) by depriving the existing

    fundamental rules and constitutional rights of officials. Apart from the above, Govt. is not maintaining parity in pay of

    employees between Secretariate & Non-Secretariate departments, as per the decision of the 6th CPC. Whether, the

    Govt. of India has gone so injustice to its employees. As a result of this iniquity of Govt., employees like me, who have

    rendered 30 years long service, are facing the loss of huge amount (ie. Rs.4000/- to Rs.5000/-) every month in our

    salaries and it will effect in pension also.

    In view of the above, I solicit to the Authorities of Govt. & National Anomaly Committee to take appropriate action
    to settle the long pending pay anomalies of 6th CPC soon to get relief to serving as well as retiring officials of the
    Govt. of India.

Now he is geeting Rs. 3000 more from me just bcoz of difference of one month in Increment.So Govt. may consider the issue of Increment to those employees whose date of increment is between 1st February to 1st June may be given an increment, as a onetime measure sympathatically and issue necessary orders to settle the anomaly so that we are not put to regular financial loss.

  31. If you completed 12 years of service on Aug 2006,then you should have been granted first ACP on 2006 itself.So there is no room for loosing 2 years of service due to MACP implimentation

    AS BY 5TH PAY COMM MY ACP FALLS ON AUG 2006,( 12 YEARS COMPLETED) BUT BY OMMITTING OF THAT ACP I WAS MINGLED IN NEW MACP SCHEME IMPLEMENTING IT ON FROM SEPT 2009, THREBY I AM LOSING 2 YEARS OF CORRESPONDING 6TH PAY.

    Sir, I request the following clarification of pay fixation that in Indian Forest Service the JAG wasissued wef 1-1-2006. The pay of 12000 has to be fixed first and the increment for JAG has to be given wef 1-1-2006 or basing on the old pay increment

    I am working as a Asstt. Professor (selecton grade) in a Govt. College in Raipur, Chhattisgarh. My date of appointment is JAN 6th 1995.I got 12000 scale on 6th JAN 2005.Yet I was fixed with my basic as 12000 on 1.1.06 instead of 12420.Again I was given basic of 37400 on 6.1.08 on completion of three years,no increment on 1.7.08 and next increment only on 1.7.09.This has resulted in my losing a huge amount of arrears and two increments due to no fault of mine.Can anyone kindly give me my correct fixation and date of increment clarification?

    My case is as like as KPS who has alredy clarified.
    I HAVE RETIRED FROM CEA ,MINISTRY OF POWER ON 30-04 2009 .MY date of increment was march 2009 I also not received any increment though in the month of Janury I received NFG scale without any additional increment & my pay fixation ,on the basis of 6th. pay commission was fixed without any additional increment.Therefore you could imagine the loss of gratuity,commutation pay leave- encashment&also pension benefit which is a recurring loss of mine I incurred .I,therefore request your goodself to advise the concern to modify the scale & accordingly order may pl.be issued to MOP,CEA so as to take the corrective measure &BALANCE PAYMENT MAY PL. BE MADE &PENSION AMOUNT MAY BE REVISED ACCORDINGLY.

  37. Imagine my loss due to the said anomaly:
    1. My old month of increment: March.

    2. My MACP month also March (But I have to wait till July for the MACP come into effect perpetually I am put into loss again)

    3. My date of retirement is April (losing one more increment)

    4. My last month emoluments will also be less and also the 10 months average will also be less for calculating the pension and commutation of pension

    4. If I get any promotion in between January to June, again the same situation occurs.

    I have still 21 years of service and one can imagine the cmulative loss in salary and pension due to above anomaly. I am suffering from above losses for no fault of mine but due to wrong policy of the Govt.

    Completely demotivated due to this grave situation.

    The losses of mine are passed to those whose increment/MACP/promotion/retirement are between July and December as profits and imagine who is paying for them.

    I wonder why the anomaly committe is sitting on this issue.
